53 law enforcement officers held disciplinarily liable
130 resolutions to refuse to initiate criminal proceedings, with materials sent for additional verification to internal affairs bodies, were cancelled by regional prosecutors based on the results of inspections conducted throughout 2007 regarding the legality of decisions taken by internal affairs bodies when issuing resolutions to refuse to initiate criminal proceedings for the theft of mobile phones.
In addition, 44 resolutions to refuse to initiate criminal proceedings were cancelled, with the simultaneous initiation of criminal proceedings under Part 1 of Article 185 of the Criminal Code of Ukraine, as the value of the stolen phone exceeded the amount of three tax-free minimum incomes of citizens at the time of the theft. Also, 45 resolutions on the initiation of disciplinary proceedings against police officers were issued, as a result of which 53 employees of internal affairs bodies were held disciplinarily liable.
We remind you that the Prosecutor of the Lviv Region, Oleksii Bahanets, sent instructions to all inter-city and district prosecutors to conduct inspections regarding the legality of decisions taken by internal affairs bodies when issuing resolutions to refuse to initiate criminal proceedings for the theft of mobile phones that occurred in 2007. In addition, the regional prosecutor gave instructions to check whether, in all cases of deciding to refuse to initiate criminal proceedings for the theft of mobile phones due to insignificance, the issue of holding the guilty person administratively liable was raised.
