Kerch Correctional Colony (No. 126)
Until 2014, the state institution “Kerch Correctional Colony (No. 126)” was part of the structure of the State Penitentiary Service of Ukraine and ensured the execution of custodial sentences within the territory of the Autonomous Republic of Crimea.
The institution belonged to the network of correctional colonies of the State Penal Enforcement Service of Ukraine and held convicted persons in accordance with the requirements of the penal enforcement legislation of Ukraine. The Kerch Correctional Colony played an important role in the functioning of the penitentiary system of the Crimean Peninsula and ensured the implementation of state policy regarding the execution of criminal sentences.
Following the commencement of the temporary occupation of the Autonomous Republic of Crimea by the Russian Federation in February–March 2014, Ukraine lost actual control over the institution. Consequently, the activities of the Kerch Correctional Colony (No. 126) as part of the State Penal Enforcement Service of Ukraine were effectively ceased. As a result of the temporary occupation, Ukrainian state authorities are unable to manage the institution or monitor the conditions of confinement for the convicted, the state of infrastructure, and the observance of human rights. Reliable information regarding the number of convicted persons, personnel, material and technical conditions, and the management of the institution is unavailable.
In accordance with the Constitution of Ukraine and the Law of Ukraine “On Ensuring the Rights and Freedoms of Citizens and the Legal Regime on the Temporarily Occupied Territory of Ukraine”, the Autonomous Republic of Crimea is an integral part of Ukraine, and state property located within its territory remains the property of Ukraine, regardless of any actual control over it.
