Donetsk Penal Institution (No. 5)
State Institution "Donetsk Penal Institution (No. 5)" was part of the structure of the State Criminal-Executive Service of Ukraine and performed the functions of a penal institution and a pre-trial detention centre.
The institution is the legal successor to the Donetsk Pre-trial Detention Centre and ensured the custody of persons taken into custody, as well as specific categories of convicts, in accordance with the requirements of Ukraine's criminal procedural and criminal-executive legislation.
In 2014, as a result of the armed aggression of the Russian Federation and the occupation of the city of Donetsk, the institution found itself in the temporarily occupied territory of Ukraine.
Ukraine lost actual control over its property complex and the ability to manage the institution in accordance with national legislation. After the establishment of the occupation administration, the institution's property complex was used for the operation of illegal penitentiary structures created by the Russian Federation in the temporarily occupied territory of the Donetsk region.
In this regard, state authorities of Ukraine are deprived of the possibility to obtain reliable information about the conditions of detention, the current state of the institution's facilities, and the manner of their use.
Thus, State Institution "Donetsk Penal Institution (No. 5)" belongs to those institutions of the State Criminal-Executive Service of Ukraine that have been in the temporarily occupied territory of Ukraine since 2014.
In accordance with the legislation of Ukraine and international law, the territory on which the institution is located is an inalienable part of Ukraine, and state property remains the property of Ukraine regardless of the actual control over it.
