Khmelnytskyi Pre-trial Detention Centre
The Khmelnytskyi Pre-trial Detention Centre is an institution of the State Criminal-Executive Service of Ukraine that provides for the execution of a preventive measure in the form of custody and performs other functions stipulated by the Law of Ukraine “On Pre-trial Detention”.
The institution is located in the central part of the city of Khmelnytskyi and is one of the main penitentiary institutions in the region. The history of the institution dates back to 1943. After the liberation of the city from Nazi occupation, the institution began to perform the functions of a pre-trial detention centre. Throughout the second half of the 20th century, its material and technical base was gradually expanded: a medical unit, a catering unit, a bath-laundry complex, production workshops, warehouse premises, an administrative building, and a new high-security building were constructed.
As a result of these reconstructions, a modern complex was formed, consisting of high-security and utility zones. Today, the Khmelnytskyi Pre-trial Detention Centre provides for the detention of persons taken into custody during the stages of pre-trial investigation and judicial review, as well as specific categories of convicted persons in accordance with the requirements of Ukrainian legislation. The specifics of the institution’s activities are determined by the Law of Ukraine “On Pre-trial Detention”, the Criminal-Executive Code of Ukraine, and normative legal acts of the Ministry of Justice of Ukraine.
The institution is regularly monitored by the National Preventive Mechanism, the Ukrainian Parliament Commissioner for Human Rights, and international and Ukrainian human rights organisations. During monitoring visits, assessments are made of the conditions of detention for those in custody, the provision of the right to medical care, access to legal aid, material and living conditions, disciplinary practices, the exercise of the right to work for convicts retained for maintenance purposes, and other aspects of human rights compliance. Following the monitoring visits of recent years, the institution has received recommendations regarding the improvement of material and living conditions, medical provision, the ensuring of privacy during the provision of medical care, the refinement of disciplinary practices, the development of infrastructure, and the alignment of the institution’s activities with the requirements of the Law of Ukraine “On Pre-trial Detention”, the Criminal-Executive Code of Ukraine, the practice of the European Court of Human Rights, the recommendations of the European Committee for the Prevention of Torture (CPT), and other international standards in the field of human rights protection.
