The following statistical data relate to the number and composition of convicts serving sentences in penal correction institutions in 2010

The State Penal Service of Ukraine consists of a central apparatus, 25 territorial management bodies of the Department, 184 institutions, 703 units of the penal inspection, and educational institutions (two initial training centres and one college of the second accreditation level).

According to data contained on the Department’s website www.kvs.gov.ua, as of 01.01.2011, there were 154,027 persons in places of detention (a year earlier – 147,716 persons), including 113,917 convicts in 141 institutions (108,187 persons), of whom 6,731 were women (6,311 women); in educational colonies – 1,434 persons (65 fewer than a year earlier); and 39,363 persons were held in pre-trial detention centres (a year earlier – 38,030; six months earlier – 40,024 persons). Over the year, the number of prisoners in the Department’s institutions increased by 6,311 persons (+4.27%), whereas in the previous year it increased by 1,770 persons (+1.21%). Higher growth rates were observed only in 1999.

The dynamics of the number of persons in the Department’s institutions over the last ten years are presented in the following Table 1.

During 2010, 47,048 newly convicted persons entered penal institutions (data in parentheses hereafter refer to 2009 – 41,411 persons), and 37,227 persons were released (39,213 persons), including 21,237 persons (20,890 persons) released on parole. Data on the composition of convicts held in the Department’s penal institutions as of 20 January 2011 are presented in the following Table 2.

The largest proportion of convicts are persons serving sentences for theft – 27,966 persons (24.55%, a year earlier 22.8%); 17,971 persons were convicted for intentional homicide (15.8%, a year earlier – 16.8%). It is evident that the increase in the number of convicts is occurring due to persons who have committed non-serious crimes.

Of the persons convicted in 2010, 25,910, or 55.1%, had previously served sentences (21,426 persons, or 51.7%). There is a slightly different ratio between first-time convicts and those who have been convicted before among all persons serving sentences (54,824 persons, or 48.1%, are serving sentences for the first time (52,833 persons, or 48.5%); 59,093 persons, or 51.9%, are not serving sentences for the first time (56,096 persons, or 51.5%)). In Ukraine, 2,332 foreign citizens, or 1.96% (2,234 persons, or 2.05%), and 6,993 stateless persons, or 6.1% (6,787 persons, or 6.2%), are serving sentences of imprisonment.

The number of life-sentenced prisoners increased in 2010 by 90 persons (in 2009 – by 68 persons) and amounted to 1,696 persons as of 20.11.2010. Of these, 1,379 persons were held in penal institutions (+36 persons during the year), and 317 in pre-trial detention centres (+54 during the year).

As noted above, the number of persons held in pre-trial detention centres in 2010 increased by 3.5% (+1,333 persons), whereas a year earlier it had increased by 11.4%, or +3,882 persons.

The occupancy rate of pre-trial detention centres across the country varies: 17 centres are under-capacity, and 15 are overcrowded (see Table 3). The highest excess capacity is in the detention centres of Donetsk (928 persons, 47%), Simferopol (446 persons, 30%), Kyiv (1,058 persons, 37%), and Kharkiv (719 persons, 25.6%). The most ‘spacious’ conditions are in the detention centres of Zhytomyr (-706 persons, 36%) and N-Siverskyi (-147 persons, 45.5%).

Despite the above, the level of application of pre-trial detention as a precautionary measure remains invariably too high. This measure is largely applied to persons who have committed non-serious crimes, yet their detention in pre-trial centres is dictated by ‘convenience’ for the investigation, as the defendant is always ‘at hand’, rather than because it is impossible not to apply such a measure.

The unjustifiable excessive use of pre-trial detention is also evidenced by statistical data on the reasons for the release of persons from detention centres, shown in Table 4. Among the main reasons for which persons were released from detention centres are the imposition of sentences not involving imprisonment, as well as the imposition of a custodial sentence, but for a relatively short term—as a rule, a term the held person has already served while in the detention centre. Throughout the year, almost one in four of those who enter a detention centre is released. It is obvious that the crimes for which they are convicted are not of a nature that warrants severe punishment.

It is worth noting that the country still lacks a post-penitentiary support system for those being released. Therefore, persons released from places of detention very often face numerous problems. If they lack social ties, resolving issues of resettlement after release can be extremely difficult for them. These problems affect thousands of people.

The execution of sentences not involving imprisonment is handled by the Penal Inspection within the Department. A few years ago, the number of persons registered with the Penal Inspection exceeded the number of prisoners held in places of detention.

As of 01.01.2011, there were over 180,000 persons on the Penal Inspection register. The largest proportion of these persons received a sentence of release from serving a sentence with probation – 125,960 persons. 22,600 persons were serving sentences in the form of community service, and 3,952 in the form of correctional labour.
