Release from serving a sentence due to health conditions

The health status of convicts is a key factor for release from serving a sentence. According to Article 84 of the Criminal Code of Ukraine, this right is held by persons who have fallen ill with a mental or other severe illness that prevents the serving of a sentence, as well as military personnel found unfit for service. The list of such diseases is approved by the joint order of the Ministry of Health and the Ministry of Justice No. 1348/5/572.
The Kharkiv Human Rights Protection Group (KHPG) provides legal assistance to convicts in the following areas:
- Violation of medical rights: inadequate care, refusal of access to a doctor, or refusal of medical examinations.
- Release due to health conditions: preparation of petitions to the court and protection of the rights of convicts whose diagnoses fall under the established List.
- Torture and ill-treatment: protection of rights in the event of unworthy treatment by institution staff.
Algorithm for requesting assistance from the KHPG
- Preparation of an application: the convict writes an application addressed to the Director of the KHPG, describing their medical problems.
- Consent to data access: it is necessary to provide written permission for access to medical confidentiality, records, and personal files.
- Submission of the request: the application is sent by regular post to the legal address of the KHPG or via official email.
A KHPG lawyer processes the request, requests information about the health status, and, after analysing the documentation, initiates court proceedings or other legal measures to protect the individual’s rights.
