Wages ranging from 64 to 2,132 hryvnias, the lack of rooms in the hospital for food storage and dining, a suspiciously low level of injury documentation, and other violations were observed by our monitors during a follow-up visit to the facility.

General Information

Berdychiv Correctional Colony (BCC) No. 70 is located at the following address: 1 Nyzhyretska Street, Berdychiv, Zhytomyr Region.

The head of the institution is Colonel of the Internal Service Oleksandr Pavlovych Dorobaliuk.

BCC No. 70 is a maximum-security facility for the confinement of men convicted of intentional, especially serious crimes, as well as men transferred from medium-security colonies for committing malicious violations of the detention regime, and convicts who committed crimes while serving their sentences.

The institution consists of a production zone, a dining hall, a residential zone with Social-Psychological Service (SPS) units, KDiR (holding and disciplinary) units, a maximum-security sector for the detention of life-sentenced prisoners (including multi-occupancy cells for life-sentenced prisoners), a maximum-security sector for the detention of persons sentenced to a fixed term of imprisonment, a medical unit, a bath and laundry complex, DISO/PKT units, DPK, punishment cells, a pre-trial detention centre (SIZO) unit, and administrative premises.

The authorised staff size of the institution is 230.5 positions. The actual number is 185 positions. The total staff shortage in the institution is 45.5 employees. Two psychologists work at the institution.

The planned capacity of the institution is 407 persons. The actual number is 261 persons, 47 of whom are serving life sentences. There are five SPS units in the institution, one of which is mothballed.

During the current year, 29 convicts have arrived at the institution, and one has arrived at the SIZO unit. One convict died in 2023. 72 persons are employed: 68 under civil law contracts and four under employment contracts. One person has spent time in the DISO, two in a punishment cell, and 17 in the DPK. Four persons were undergoing treatment in the medical unit.

Preliminary Remarks

The previous visit to BCC No. 70 by the monitoring group took place on 24 June 2022.

Based on the results of the previous visit to the institution, it was established that:

  1. In the DISO premises, the toilet does not have a door, and dampness is noticeable in the rooms;
  2. In the DPK premises, the water tap is faulty;
  3. Some residential premises are in need of repair;
  4. There are violations of the right to medical care.

The recommendations provided following the previous visit were partially implemented, namely: the residential premises were repaired.

Medical Unit No. 70 of the Branch of the State Institution “Centre for Health Care of the State Criminal-Executive Service of Ukraine” in the Zhytomyr Region

The head of Medical Unit No. 70 of the branch of the state institution “Centre for Health Care of the State Criminal-Executive Service of Ukraine” in the Zhytomyr region (hereinafter — the medical unit) is Volodymyr Stanislavovych Balitskyi.

The inpatient facility of the medical unit has two wards for somatic patients, designed for seven beds, and one infectious disease isolation ward designed for one bed. According to the staffing table, there is a vacant position: general practitioner — family doctor — 1 post. On the day of the visit, four people were in the inpatient facility of the medical unit.

During the visit, the monitoring group examined medical documentation and inspected the premises of the medical unit for compliance with the requirements of Ukrainian legislation and international standards. Deficiencies in the work of Medical Unit No. 70 were identified, which lead to the violation of the rights of convicts at Berdychiv Correctional Colony No. 70, in particular:

1. Violation of the right of convicts to protection from torture or inhuman or degrading treatment or punishment (Article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms) and violation of the right to health care and medical assistance (Article 49 of the Constitution of Ukraine)

1.1 In violation of Clause 37 of the Resolution of the Cabinet of Ministers of Ukraine No. 285 dated 02.03.2016 “On Approval of Licensing Conditions for Conducting Business Activities in Medical Practice”, there is no document confirming free access to the buildings and premises of the medical facility for persons with reduced mobility, which is mandatory.

1.2 In accordance with the requirements of Clause 7 of Part 1 of the Resolution of the Cabinet of Ministers of Ukraine dated 22.12.2023 No. 1394 “Some Issues of Implementation of the Programme of State Guarantees of Medical Services for the Population in 2024”, the National Health Service of Ukraine (NHSU) pays for medical services provided based on paper referrals for patients held in institutions for the execution of sentences or pre-trial detention centres of the State Criminal-Executive Service, until the health care facilities of the State Criminal-Executive Service have created the technical capability to issue electronic referrals. However, due to the fact that the convicts have not concluded declarations with a primary care physician, they do not have the opportunity to receive the necessary medical services at the expense of the NHSU, which leads to a violation of the requirements of paragraphs 4 and 5 of Article 4 of the Law of Ukraine “Fundamentals of the Legislation of Ukraine on Health Care”.

1.3 In violation of the requirements of the Instructions for completing primary accounting documentation form No. 003-6/o “Informed voluntary consent of the patient to diagnosis, treatment, surgery, anaesthesia, and the presence or participation of participants in the educational process”, approved by the Order of the Ministry of Health of Ukraine dated 14.02.2012 No. 110, the absence of informed voluntary consent for diagnosis and treatment signed by patients in the inpatient facility in the isolation ward for persons with mental disorders was established.

The aforementioned may indicate a lack of voluntary consent from patients for the application of diagnostic, preventive, and treatment methods, which is a violation of Article 43 of the Law of Ukraine “Fundamentals of the Legislation of Ukraine on Health Care” and Clause 47 of the recommendations of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT/Inf(93)12-part) (hereinafter — CPT Standards).

1.4 According to the injury register, four cases were recorded in the institution in 2023. At the same time, in 2024, according to medical documentation, not a single case of bodily injury was recorded. Such a low level of injury documentation, given the actual number of convicts, indicates that convicts do not seek help from the medical unit of Berdychiv Correctional Colony No. 70 when sustaining injuries and that there is a formalistic approach to the documentation of bodily injuries by medical staff during medical examinations of convicts.

In turn, the failure to document bodily injuries in a proper manner does not comply with Clause 60 of the recommendations of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT/Inf(93)12-part), which states that medical services in places of detention can contribute to the prevention of violence against persons held in custody through the systematic registration of bodily injuries, as well as, if necessary, by informing the appropriate authorities.

1.5 The medical unit has not organised the provision of opioid substitution therapy (hereinafter — OST) for persons with mental and behavioural disorders resulting from opioid use, in accordance with the Procedure for conducting opioid substitution therapy for persons with mental and behavioural disorders resulting from opioid use, approved by the Order of the Ministry of Health of Ukraine dated 27.03.2012 No. 200.

Drug-dependent persons are not provided with social-psychological support, cognitive behavioural therapy (CBT), relapse prevention, motivational interviewing, mutual aid groups, etc.

Thus, these persons are deprived of the opportunity to receive OST, which violates their right to choose methods of treatment in accordance with Article 38 of the Law of Ukraine “Fundamentals of the Legislation of Ukraine on Health Care”. At the same time, the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment expresses a clear position that prisoners should have access to substitution maintenance therapy (OST) to the same extent as free persons, and should meet the general principle of equivalence of medical care in institutions for the execution of sentences and among free persons (Report of the Committee on the results of the visit to Ukraine in 2009 (140.CPT / Inf (2011) 29), and 2013 (164.CPT/Inf (2014) 15)).

1.6 During the inspection of the DISO unit, monitors established that when a convict is placed in a disciplinary isolation unit, it is common practice to attach a medical certificate to the file which contains information about their state of health, complaints, and a conclusion stating that the convict can be held in the DISO, PKT, or punishment cell. The identified facts confirm that the institution’s staff possess confidential information about the state of health of the convicts who are in the DISO unit. The aforementioned violates the requirements of Article 39-1 of the Law of Ukraine “Fundamentals of the Legislation of Ukraine on Health Care” regarding the right of persons to confidentiality concerning the state of their health.

Furthermore, the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment has repeatedly recommended that doctors should not certify that the state of health of convicts allows for placement in DISO/PKT. In this regard, the CPT would like to emphasise that medical staff working in institutions for the execution of sentences are the personal doctors of prisoners, which ensures the existence of a positive doctor-patient relationship and is an important factor in maintaining the health, well-being, and welfare of prisoners. The above undermines the positive relationship between convicts and doctors (Report of the Committee on the results of the visit to Ukraine in 2005 (144.CPT/Inf (2007) 22), 2009 (151.CPT/Inf (2011) 29)). In addition, it contradicts Clause 43.3 of the European Prison Rules.

2. Lack of medical equipment, medical supplies, and medicines in the medical unit. Violation of fire safety rules

2.1 In violation of the requirements of the Equipment Supply Table for one workplace of a dentist and dental technician, approved by the Order of the Ministry of Health of Ukraine dated 11.04.2005 No. 158, the medical unit lacks a dental X-ray machine, which makes it impossible to conduct in-depth dental examinations of convicts and does not ensure the timely provision of proper dental care.

2.2 During the check of the defibrillator's operability, it was established that the electrodes were missing. At the same time, the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment has recommended that medical services in all visited prisons (and all other penitentiary institutions in Ukraine) be equipped with life-saving equipment for doctors (Report of the Committee on the results of the visit to Ukraine in 2017, 87. CPT/Inf (2018) 41).

2.3 In violation of the requirements of the Order of the Ministry of Health of Ukraine dated 16.12.2003 No. 584 “On Approval of the Rules for Storage and Quality Control of Medicines in Medical and Preventive Institutions”, medicines are stored without regard to the temperature regimes specified by the manufacturers. In the medicine storage room, one package of the medicinal product “Vitaxon” and one package of “Ascorbic Acid” were found in a cabinet; their storage conditions must not exceed a temperature of 8°C. Furthermore, in this room, due to the lack of an installed air conditioner, it is impossible to maintain the air temperature in accordance with the requirements of the instructions for the use of medicinal products during the summer period (Clause 4, Section II, Paragraph 9 of Clause 3, Section V of the Order of the Ministry of Health No. 584 as amended by the Order of the Ministry of Health No. 610 dated 03.04.2022).

2.4 In violation of the Procedure for organising medical care at the primary, secondary (specialised), and tertiary (highly specialised) levels using telemedicine, approved by the Order of the Ministry of Health of Ukraine dated 19.10.2015 No. 681, the medical unit staff are deprived of the ability to make requests for telemedical consultation and receive consultation for the provision of medical care to convicts due to technical reasons.

2.5 In violation of the Requirements for Bedding, Special Clothing, and Special Footwear (Inventory Property) for Convicts undergoing treatment in medical and preventive institutions, facilities on the rights of medical institutions, and in medical units at institutions for the execution of sentences and pre-trial detention centres, approved by the Order of the Ministry of Justice of Ukraine dated 20.02.2012 No. 280/5, convicts do not receive hospital property (hospital suit, gown, and slippers). Convicts remain in the inpatient facility in their everyday clothes, sometimes with their own bedding.

2.6 In violation of the Fire Safety Rules in Ukraine, approved by the Ministry of Internal Affairs of Ukraine dated 30.12.2014 No. 1417, the premises of the medical unit are not equipped with fire extinguishing and fire alarm systems; there are damaged sockets and exposed electrical wires.

2.7 The doctor’s office and X-ray room are not equipped with fire extinguishers, which is a violation of the requirements of Clause 3.6 of Chapter 3 of Section V of the Rules and a violation of Clause 10.18 of Chapter 10 of the State Sanitary Rules and Norms “Hygienic requirements for the design and operation of X-ray rooms and the performance of X-ray procedures”, approved by the Order of the Ministry of Health of Ukraine dated 04.06.2007 No. 294, registered with the Ministry of Justice of Ukraine on 07.10.2007 under No. 1256/14523.

2.8 According to Clause 2.23 of Chapter 2 of the State Sanitary Rules and Norms “Hygienic requirements for the design and operation of X-ray rooms and the performance of X-ray procedures”, approved by the Order of the Ministry of Health of Ukraine dated 04.06.2007 No. 294, registered with the Ministry of Justice of Ukraine on 07.11.2007 under No. 1256/14523, it is not permitted to place equipment in the procedure room that is not provided for by the design documentation. At the same time, in violation of these requirements, extraneous equipment is stored in the X-ray room. Furthermore, the premises are in a dilapidated state and require major repairs. The aforementioned does not ensure safe conditions for patients and may pose a threat to their life and health.

2.9 In violation of the requirements of the Standards for the provision of furniture, inventory, and household items for a maximum-security correctional colony, approved by the Order of the Ministry of Justice of Ukraine dated 27.07.2012 No. 1118/5 (hereinafter — Provision Standards), the following rooms are missing in the medical unit: a room for storing food and clean dishes, and a dining room. Due to this, convicts are forced to eat and store food in the wards. The absence of the above list of premises violates the right of convicts undergoing treatment to dignified conditions of detention and leads to a violation of sanitary and hygienic standards.

2.10 In violation of Article 115 of the Criminal-Executive Code of Ukraine, the isolation ward does not comply with the requirements regarding the standard of living space per convict in inpatient treatment conditions (no less than 5 m²). The total area of the somatic patient ward where five beds are located, according to the building plan, is only 19.1 m².

3. Violation of the right to proper psychiatric care

In violation of Clause 8 of Part 5 of Chapter 2 of the Procedure for organising the provision of medical care to convicts deprived of liberty, approved by the joint Order of the Ministry of Justice of Ukraine and the Ministry of Health of Ukraine dated 15.08.2014 No. 1348/5/572, the inpatient facility lacks a properly equipped isolation ward for persons with mental disorders for convicts who pose a danger to others.

4. Non-compliance with infection control and epidemiological surveillance. Violation of the right to privacy

4.1 In violation of the Measures and Means for preventing infection when providing patient care, approved by the Order of the Ministry of Health of Ukraine dated 03.08.2020 No. 1777, the medical unit is equipped with only one isolation ward for infectious patients, which makes it impossible to simultaneously house patients with dangerous infectious diseases separately from one another and from other convicts.

4.2 In violation of the requirements of Rule 19.3 of the European Prison Rules (Recommendation No. R (2006) 2 of the Committee of Ministers of member states), the bathroom in the isolation ward for infectious patients and in the somatic patient ward is not equipped with a door, meaning that the right of convicts to privacy is not respected.

5. Violation of the rights of convicts and detainees during initial and preventive medical examinations

According to Clause 7 of Chapter III of Section II of the Procedure, convicts working at food facilities (except for jobs related to the positions of sellers, managers of food and clothing warehouses, storekeepers), in the processing industry, in infant homes, secondary education institutions, vocational training units in special educational colonies, medical units (feldsher posts), and hospitals of the SCES (except for work related to the provision of medical care), laundries, baths, rooms for long-term visits, dormitories, clubs, at water supply and sewage facilities, and sites for animal breeding and rearing, undergo mandatory preliminary and preventive medical examinations in accordance with the Resolution of the Cabinet of Ministers of Ukraine dated 23.05.2001 No. 559 “On Approval of the List of Professions, Industries, and Organisations whose Employees are Subject to Mandatory Preventive Medical Examinations, the Procedure for Conducting These Examinations, and Issuing Personal Medical Books”. For each convict of the specified category, primary accounting documentation form No. 1-OMK “Personal Medical Book” is opened, approved by the Order of the Ministry of Health of Ukraine dated 21.02.2013 No. 150, registered with the Ministry of Justice of Ukraine on 23.04.2013 under No. 662/23194.

At the same time, the monitoring group recorded the absence of personal medical books for two canteen workers and the absence of examination results in the medical documentation conducted by specialist doctors (including laboratory, clinical, and other studies) necessary for admission to work at food facilities.

6. Violation of the rights of persons with viral hepatitis C

In violation of the requirements of the Standards of medical care for HCV in adults, approved by the Order of the Ministry of Health of Ukraine dated 15.01.2021 No. 51, not all persons with suspected viral hepatitis C undergo PCR testing, due to which people do not receive the necessary treatment, which may lead to a deterioration in their health and the spread of the aforementioned infectious disease among convicts and detainees.

7. Violation of the rights of persons with disabilities (Article 9 of the UN Convention on the Rights of Persons with Disabilities)

7.1 Dispensary observation is carried out for 12 persons with disabilities. Of them, one is Group I; three are Group II; and eight are Group III. At the same time, in violation of the requirements of the Law of Ukraine “On the Rehabilitation of Persons with Disabilities in Ukraine”, persons with disabilities do not receive proper diagnostic, treatment, and rehabilitation measures despite the existence of information confirming persistent impairment of bodily functions caused by illnesses or the consequences of injuries that cause limitations in normal life activity.

During the study of the convicts' medical documentation, it was established that two persons with disabilities do not have Individual Rehabilitation Programmes (IRP). Furthermore, the recommendations of the IRP are not being fulfilled, due to which people do not receive proper diagnostic, treatment, and rehabilitation measures despite the existence of information confirming persistent impairment of bodily functions caused by illnesses and consequences of injuries that cause limitations in normal life activity.

7.2 In violation of the requirements of the State Building Norms of Ukraine V.2.2-17:2006 “Buildings and structures. Accessibility of buildings and structures for persons with reduced mobility”, conditions for housing persons with disabilities have not been created in the medical unit (there are no ramps, handrails, etc.).

8. Violation of the right of convicts to proper sanitary and hygienic conditions of stay in a health care facility

8.1 Certain premises of the medical unit do not meet the requirements of Article 22 of the Law of Ukraine “On Ensuring Sanitary and Epidemic Well-being of the Population” and Clause 53 of the CPT Standards. The cell-wards of the medical unit require repair work, including the replacement of sanitary and technical equipment. The wards are significantly cluttered with personal belongings; bedding and some mattresses need replacement.

8.2 In violation of the “State sanitary-anti-epidemic rules and norms regarding the handling of medical waste”, approved by the Order of the Ministry of Health of Ukraine dated 08.06.2015 No. 325, the branch of the State Institution “Centre for Health Care of the SCES of Ukraine” in the Zhytomyr Region has not concluded an agreement with a specialised institution for the disposal of medical waste, due to which proper collection, sorting, and disposal of medical waste have not been organised in the medical unit since the beginning of 2024.

9. Violation of the right to work and social protection

In accordance with Article 118 of the Criminal-Executive Code of Ukraine, convicts deprived of liberty have the right to work. Work is carried out on a voluntary basis on the basis of a civil law contract or an employment contract.

According to Article 26 of the Law of Ukraine “On Compulsory State Pension Insurance”, persons have the right to an old-age pension after reaching the age of 60, provided they have a certain insurance period.

During the monitoring visit, working convicts were interviewed at the institution's production site and in the workshops. Relevant documentation was checked.

Convict Zh., convict Ch. — manufacturing of concrete structures.

Convict S., convict U., convict Z. — manufacturing of metal products.

Convict P., convict B. — sewing gloves.

Convict K. — car repair.

According to the certificate of wages/remuneration accrued to the convicts for March, convict Zh. received 2,132 hryvnias, convict Ch. — 1,959 hryvnias, convict S. — 64 hryvnias, convict K. — 520 hryvnias.

According to Article 119 of the Criminal-Executive Code of Ukraine, the work of persons sentenced to deprivation of liberty is paid according to its quantity and quality. In addition, Clause 5.1 of the Instructions on working conditions and wages of persons sentenced to restriction of liberty or deprivation of liberty, approved by the Order of the Ministry of Justice of Ukraine dated 07.03.2013 No. 396/5, states that the wages accrued to convicts, provided they meet output quotas or working hours, cannot be less than the legislatively established minimum wage. Convicts should receive the minimum wage.

At the same time, according to civil law contracts and the wage certificate for March 2024, the earnings of the respective convicts ranged from 64 to 2,132 hryvnias, which is significantly less than the minimum wage in the country, which as of August 2023 is 6,700 hryvnias.

At the same time, it is worth noting that the employees among the interviewed convicts who work in the institution in production and in the workshops produce goods and systematically perform defined labour functions, which is a sign of labour legal relations, not civil ones. Therefore, it is necessary to conclude employment contracts with such employees, not civil law contracts.

We remind you that employees who systematically perform defined labour functions, while legal relations regarding them are formalised as civil law rather than within the framework of a fixed-term employment contract, are deprived of the right to be provided with material and technical means necessary for performing the work, the right to safety and harmless working conditions, and the right to an equipped workplace in accordance with the requirements of regulatory acts on labour protection. Contributions and payments of the unified contribution for compulsory state insurance are not made for them. Accordingly, their pension service is not counted, and social security standards are not realised.

10. Other violations

10.1. In the sleeping area where life-sentenced prisoners live, the beds are placed close together, which violates the right to privacy.

11. Inadequate detention conditions in the DISO

Violation of the right to dignified detention conditions (Article 25 of the Universal Declaration of Human Rights, Article 48 of the Constitution of Ukraine).

Since 2015, amendments have been made to the regulatory acts governing the activities of correctional colonies, and the provision that provided for the fastening of beds to walls in disciplinary premises during the daytime has been excluded.

Despite this, the means for such fastening have been preserved in the institution's DISO premises, which creates conditions for possible abuse by the institution's staff and acts as an additional punitive element during punishment, as convicts are deprived of the opportunity to sit and lie on the bed during the day.

Recommendations:
